Meta’s Stance on the EU’s AI Code of Practice

In a significant announcement, Meta has declared its unwillingness to sign the European Union’s artificial intelligence (AI) code of practice agreement. The company, which is a major player in the AI landscape, cautions that “Europe is heading down the wrong path on AI.” This statement was articulated by Meta’s global affairs chief, Joel Kaplan, and reflects growing concerns over the regulatory environment in the EU.

Understanding the EU Code of Practice

Published on July 10th, the code of practice is a voluntary framework aimed at assisting companies in adhering to the forthcoming AI Act’s guidelines for general-purpose AI. Although the code itself is not legally binding, it offers a pathway for AI model providers to navigate the rules more effectively. By signing the code, companies could potentially benefit from a “reduced administrative burden and increased legal certainty,” contrasting with those who opt out and may face stricter regulatory scrutiny.

Meta’s Concerns

Kaplan elaborated on Meta’s decision in a statement on LinkedIn, indicating that the code introduces significant legal uncertainties for model developers. He asserts that many of the requirements embedded within the code exceed the original scope of the AI Act. As the AI industry faces rapid advancements and evolving challenges, Meta’s leadership believes that excessive regulation could hinder innovation and development in the region.

The Broader Regulatory Context

With the AI Act set to come into effect on August 2nd, companies that provide general-purpose AI will be required to maintain transparency regarding training processes and security risks associated with their models. Additionally, compliance with EU and national copyright laws will also become mandatory. Notably, the EU has established robust penalties for non-compliance, allowing for fines of up to seven percent of annual sales. This raises the stakes for companies as they navigate their relationships with the EU’s regulatory framework.

Industry Backlash and Calls for Delay

The unease expressed by Meta is not an isolated perspective. In a broader industry pushback, over 45 companies and organizations—including notable names like Airbus, Mercedes-Benz, and Philips—have advocated for a two-year postponement of the AI Act’s implementation. They argue that additional time is necessary to clarify compliance uncertainties and refine the regulatory framework, which many believe could otherwise stifle innovation within the European tech landscape.

A Diverse Response from the AI Ecosystem

In contrast to Meta’s resistance, other companies like OpenAI have announced their intention to sign the EU’s code of practice, signaling a willingness to engage with the regulatory landscape. This divergence within the tech industry exemplifies how varying priorities and strategies inform responses to regulatory challenges—some see it as an opportunity for clarification and support, while others perceive it as a potential threat to progress.
